How Insurance Companies Can Deny or Underpay Claims
Insurance companies often determine coverage based on an engineer’s report, prepared by an engineer they hire and pay. This can sometimes lead to biased reports whereby the engineer exceeds his or her authority and opines on topics not relevant to their expertise. In one case, Attorney Peterson compelled the insurance carrier to reverse its denial of coverage by criticizing the engineer’s report and pointing out that most of the report involved the engineer assuming how certain people acted after a loss, rather than explaining why a specific device became damaged.
Similarly, engineers may attempt to compare their findings to the policy language and make a policy decision, which is wholly inappropriate. Knowing when these types of situations occur and how to handle them can mean the difference between continued denial or coverage.
