What is mediation?

Mediation is a private, confidential process for resolving disagreements outside of the court system (litigation). The mediator acts as a neutral third party and helps find a solution that everyone finds acceptable. Mediation is voluntary, and you can withdraw at any time during the process. Once you've reached a tentative agreement, it is written up for your review and can then be turned into a formal written agreement. Nothing is legally binding until both parties have signed that formal agreement. Then it does become a binding legal contract.

What types of disputes are good candidates for mediation?:

  • Marriage and relationship issues (divorce, separation, pre and postnuptial agreements domestic partnerships, division of assets/property, spousal support)
  • Parenting issues (custody, parenting time and parenting agreements, child support issues, health and education decisions)

The Benefits of Mediation

Mediation serves the needs of the couple and the family. People who agree to get divorced can often find common ground and do not need to go through the courts. In these cases mediation may be a good fit. Many people find that mediation is:

  • Less stressful that the court.
  • More flexible and a faster process.
  • Confidential.
  • A safe place for difficult discussions.
  • You will be treated fairly.
  • Your voice will be heard.
  • You are in control of decision making.
  • Cost effective.
  • Tailored to your schedule.
  • Promotes mutual respect and dignity.

Generally, mediation sessions are scheduled to last from 1 to 2 hours depending on your needs and available time. A typical Mediation can be accomplished in 4 to 8 sessions, depending on the complexity of assets and issues. Mediation fees are usually paid at the end of each session, with a relatively small retainer to cover the cost of document review, and writing the Divorce Agreement.
